PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE VISITING AND/OR USING OUR SITE OR PURCHASING A TICKET FOR A RAFFLE DRAW AT ONE OF OUR TICKET COUNTERS.

1. Terms of use

1.1 These terms of use (together with the documents referred to in it, which include, without limitation, the specific Big Ticket draw rules and procedures, as applicable) (“terms”) tell you the terms on which you may visit our website www.bigticket.ae or our mobile application (together, "our site"), whether as a guest or a registered user, or purchase a ticket at one of our ticket counters. Use of our site includes accessing, browsing, registering to use, or visiting our site.

1.2 Please read these terms carefully before you start to use our site or purchase a ticket at one of our ticket counters, as these terms will apply to your use of our site and/or any ticket purchase.

1.3 By using our site (which includes accessing, browsing, registering to use, or visiting our site) or purchasing a ticket at one of our ticket counters, you confirm that you accept these terms and that you agree to comply with them. You also confirm that you accept our specific rules and procedures in relation to the specific Big Ticket raffle draw that you purchase a ticket for. Your continued use of our site, your online account and/or your continued purchase of tickets for our raffle draws confirms your continued acceptance of these terms and any changes made to them from time to time.

1.4 If you do not agree to these terms, you must not use or visit our site or purchase tickets for our raffle draws.

2. Important information of key terms

2.1 You can only use or visit our site, or purchase a ticket for a raffle draw, if you satisfy the conditions set out in section 4.4, which include, without limitation, being a natural person, at least 18 years old and not a prohibited person. If you do not satisfy these conditions, we will not be liable to pay any prize to you (see section 7.8).

2.2 You can only claim a prize if you are the named winner on the relevant ticket and only based on the official results of the relevant draw published on our site (see section 7.1)

2.3 Participation in a syndicate is entirely at your own risk. We have no responsibility or liability whatsoever for: (a) the existence, formation, or operation of any syndicate; (b) the sharing or allocation of any prize among syndicate members; or (c) any disputes, claims, or disagreements arising between syndicate members (see section 9.2).

2.4 You can only use our site or purchase a ticket for a raffle draw if you are physically located in a jurisdiction where it is lawful for you to do so (see section 4.4). We will not be liable to grant any prize to you where you have used our site to purchase a ticket in a jurisdiction where it is unlawful to do so (see section 7.8).

2.5 These terms limit our liability to you, including our liability to grant any prize to you in certain circumstances (see sections 4.8, 5.1, 7.8, and 22). We will not be liable to grant you any prize in certain circumstances, which include, without limitation, where you have not claimed your prize within 180 days, if your entry was dishonest or illegal or if you do not provide us with any requested information to verify your claim.

2.6 If an error, malfunction, misconfiguration, failure, or defect – whether visual, technical, system-related, or human in nature – impacts the draw process or results in the incorrect award of winnings, we may take corrective action, including voiding the draw outcome, and/or winnings (see sections 6.7, 6.9 and 6.13).

For our live mechanical draws, the outcome determined by our draw machine after the mechanical draw has taken place constitutes prima facie evidence of the correct outcome and prevails over any inconsistent displays on our site (see section 6.3); and
For our digital draws using random number generators, the outcome recorded on our servers will be treated as prima facie evidence of the correct outcome and prevails over any inconsistent displays on our site (see section 6.4).

2.7 If you win a grand cash prize, you must claim this in person at our office in Abu Dhabi and payment will be made to you by cheque. Other cash prizes will be paid into a bank account in your name once we have validated your claim (see section 8).

2.8 If you win a prize, you consent to us publicly disclosing and publishing your identity and image to market and advertise our site and our raffle draws, except where you object in writing on particular cultural, religious or other reasonable grounds for refusal (as determined by us in our sole discretion) (see section 14).

2.9 In certain circumstances we may make decisions which affect you and your use of our site or participation in our raffle draws, including whether or not to grant any prize to you. For example, we may, at our discretion, disqualify your online account and/or any of your tickets if we believe you are in breach of these terms. Provided these decisions are reasonable, they will be final and binding on you (see section 19).

2.10 Where there is a conflict between these terms of use and any other documents incorporated into the terms, the following order of precedence shall apply: firstly, these terms of use, secondly, our specific Big Ticket draw rules and game procedures, thirdly, any Promotional Terms, fourthly, these key terms in this section 2, and lastly, our privacy policy.

2.11 Please note that these terms are subject to change at our discretion. We will notify you of any material changes to these terms from time to time (see section 15).

3. Information about us

Big Ticket, comprising such raffle draws specified on our site (“Big Ticket Draws”), is organised and managed solely by The Big Ticket LLC, a limited liability company incorporated in accordance with the laws of, and with a registered office in, the Abu Dhabi Airport Free Zone and whose commercial licence number is ADAFZ00444 ("we", “us” or “our”). We are the official operator for the Big Ticket Draws in the United Arab Emirates (“UAE”) and the operator of the site.

4. Online account registration and eligibility to purchase a ticket

4.1 You can purchase a ticket for one of our Big Ticket Draws online via our site or in store at one of our ticket counters.

4.2 To purchase a ticket online via our site, you must have a registered account (“online account”) with us. Please note that you are only allowed to have one online account registered with us.

4.3 For in store purchases, you do not need an online account. However, if you do not have an online account with us, we will assign you a customer ID. This customer ID will be linked with any online account you subsequently create with us.

4.4 In any case, you can only register for an online account and/or purchase a ticket for one of our Big Ticket Draws if:

you are a natural person;
you are aged 18 or over;
you are not prohibited or restricted from doing so under the laws of your jurisdiction of residence or the jurisdiction in which you are located, in each case as may be determined by us from time to time (and the ability to register an online account and purchase a ticket does not constitute an offer or invitation by us for persons to create an online account or purchase a ticket in any jurisdiction in which such activities are prohibited or restricted);
you are not prohibited from doing so by targeted financial sanctions or AML/CFT laws applicable to our business, as determined by us in our discretion from time to time;
you are not on a global list of high-risk and/or sanctioned individuals, as determined by us in our discretion from time to time;
you have never undertaken a criminal or dishonest act and have never been associated with anyone who has undertaken a criminal or dishonest act, including, in each case, money laundering;
you are not on any gaming exclusion list, whether voluntary or involuntary and whether in the UAE or outside the UAE;
you are not one of our directors or employees;
you are not a director or employee of one of our key contractors or sub-contractors (as specified by us from time to time and which may include, without limitation, production and broadcasting companies involved in draws, advertising agencies, public relations agencies, consultants and audit firms); and
where required, you are able to verify, in whatever way we decide, that any information supplied to us is genuine.

4.5 By purchasing a ticket and/or registering for an online account, you represent, warrant and agree that you are eligible to do so in accordance with the requirements of section 4.4 above. We cannot provide you with any legal advice or assurances in respect of your purchase of a ticket and/or use of your online account and we make no representations whatsoever as to the legality of your participation in our Big Ticket Draws in any jurisdiction. You should check the relevant laws in your jurisdiction before purchasing a ticket.

4.6 To open an online account and continue to use our site and/or purchase a ticket, you also agree to provide certain information to us from time to time to help us meet our legal and regulatory obligations and to establish whether or not you meet the criteria set out in section 4.4 and are eligible to participate in our Big Ticket Draws. This information may include, for example, your full name, address, date of birth, gender, email address, telephone number, nationality, and/or Emirates ID or passport number and expiration date. We reserve the right to carry out checks to establish the above and to verify (or ask a third party authentication agency to carry out checks to verify) your age and identity and any other details provided to us (for example your bank account details), and to ask you for further documentation to verify the same. If you do not provide us with such information, you will not be able to register for an online account and/or purchase a ticket for our Big Ticket Draws.

4.7 You represent, warrant and agree that all information provided to us is true, genuine, accurate, and up to date.

4.8 If we subsequently discover, or have suspicion to be believe, that you were not or are no longer eligible to purchase a ticket and/or open, hold or use an online account, we reserve the right to take all appropriate steps in relation to you and your online account (including, without limitation, terminating your online account or refusing any ticket purchases by you in accordance with section 13.3, and investigating any security issues).

4.9 Only the online account holder who registered for the online account can use that online account.

4.10 Purchasing a ticket for one of our Big Ticket Draws if you are under the age of 18 is a criminal offence and anyone who facilitates a person who is under 18 to participate in our Big Ticket Draws will have committed a criminal offence and will be prevented from participating in our Big Ticket Draws in the future.

4.11 You hereby represent, warrant and agree that you will only use our site, purchase tickets for our Big Ticket Draws and/or access your online account honestly and in good faith.

5. Purchasing a ticket

5.1 You must not use any payment method belonging to a third party to purchase a ticket. You should only use payment methods of which you are the registered account holder. Any fraudulent or unauthorized use of payment cards is prohibited and will result in automatic draw disqualification and irrevocable forfeiture of any prize.

5.2 You are solely responsible for verifying, at the time of purchase, the details, accuracy, legibility and, if applicable, condition of your ticket. Information on the ticket must not be removed, altered, defaced, modified, copied or reproduced in any way after purchase. Any ticket which is lost, damaged or altered, will be invalidated at our sole discretion.

5.3 Once purchased, all ticket sales are final and no refunds will be given under any circumstances, unless otherwise specifically stated.

5.4 For any ticket purchased at one of our ticket counters, our sales associate will drop the relevant portion of your ticket into the raffle drum located at the store immediately after purchase. You are responsible for ensuring that you witness this.

5.5 For the avoidance of doubt, a ticket is only valid for the draw series stated on the ticket and is not transferable to another draw series.

6. Draws and winning tickets

6.1 Our Big Ticket Draws are games of chance and we therefore make no warranties, representations, promises or guarantees of any particular outcome. There is no cap or limit on the number of entrants for each Big Ticket Draw and we are under no obligation to disclose details of the number of tickets sold for each Big Ticket Draw.

6.2 Each Big Ticket Draw will be conducted in line with our draw procedures.

6.3 For our live mechanical Big Ticket Draws (i.e. conducted using our raffle drum), the outcome of each draw is determined by our draw machine (or any other equipment we may from time to time determine), through which winning tickets are selected at random in the presence of witnesses who are responsible for verifying the draw process. The outcome determined by our mechanical draw constitutes prima facie evidence of the correct outcome and prevails over any inconsistent displays on our site.

6.4 For our digital Big Ticket Draws, the outcome of each draw is determined using independently certified random number generators and the outcome recorded on our servers will be treated as prima facie evidence of the correct outcome and prevails over any inconsistent displays on our site.

6.5 Unless otherwise specifically stated, each ticket drawn is limited to winning one prize per draw and you shall be deemed to accept the prize first awarded to you.

6.6 We will decide the time, frequency, date and method of draws for each applicable Big Ticket Draw.

6.7 If a Big Ticket Draw is interrupted or impacted because of error, malfunction, misconfiguration, equipment failure, defect, or for any other reason (whether visual, technical, system-related, or human in nature), the draw will either be re-started or declared invalid, as determined by us in our discretion. If any Big Ticket Draw is declared invalid, or cannot take place on the date or at the time scheduled, another draw will take place as soon as reasonably possible thereafter.

6.8 Where we consider it reasonable to do so, we may also postpone a Big Ticket Draw for as long as we consider to be appropriate in the circumstances and we will use reasonable endeavours to notify you of the same. Such circumstances may include public holidays, national periods of mourning or emergency or technical or logistical problems with holding a draw.

6.9 For the avoidance of doubt, in the event of any alleged error, malfunction, fault, mistake, misunderstanding, or dispute concerning the operation or outcome of any part of a Big Ticket Draw, or our networks or systems, our decision will be final.

6.10 If a Big Ticket Draw is declared invalid or cannot take place and, in either case, is not rescheduled in accordance with section 6.7, we will refund you the amount you paid for the ticket entry into the draw.

6.11 Official draw results will be published on our site and via our social media platforms, including Facebook (https://www.facebook.com/BigTicketAbuDhabi) and Instagram (https://www.instagram.com/bigticketauh) after the relevant draw.

6.12 We have robust control measures to prevent incorrect winning ticket numbers being announced or published on our site or social media platforms. However, in the event of any discrepancy between the winning ticket numbers published on our site and the winning ticket numbers published by us elsewhere (due to human error, technical issues or otherwise), subject to sections 6.3 and 6.4, the winning ticket numbers announced or published on our site shall prevail as the correct outcome.

6.13 In the event of any incorrectly announced or published winning ticket numbers, we will use reasonable endeavours to correct the position following such event and notify players accordingly. However, we will not be required to make any payment against any incorrectly announced winning ticket numbers (whether published by us or any third party) and you will not be entitled to claim any compensation in connection with the same.

7. Claiming a prize and validation requirements

7.1 You can only claim a prize if you are the named holder of a winning ticket for a Big Ticket Draw based on the official results of the relevant draw published on our site, in each case in accordance with these terms. We will not pay any prize based on results recorded anywhere else, including, for example, in newspapers, winning ticket telephone lines or third party websites. We will contact you, using your registered contact details, after the relevant draw to inform you how to claim your prize.

7.2 Winners must collect their prize within 180 days from the relevant draw date. If a winner fails to do so, the prize will be irrevocably forfeited. Any unclaimed prizes will not be added to future Big Ticket Draws.

7.3 If you are a grand cash prize winner or the winner of a car or gold, you are required to sign a copy of the relevant prize collection form in order to collect your prize.

7.4 All winners are also required to promptly provide us with such documents and information as we may require to validate your winning ticket and verify your age, identity and/or eligibility. This could include (without limitation):

a copy of your portion of the original winning ticket (for tickets purchased in store at one of our ticket counters) or a PDF version of the winning ticket (for tickets purchased online via our site);
proof of your identity in the form of a passport or national identification document used for registration at the time of ticket purchase; and/or
proof of residential address dated within the last three months.

7.5 Cash prize winners, except for grand cash prize winners, are required to promptly provide us with such documents and information as we may require for processing prize payments via bank transfer. This could include (without limitation):

a bank transfer authorization letter; and/or
a stamped bank issued letter confirming the winner’s identification in line with section 7.4(b) and bank account details.

7.6 If you are a Dream Car prize winner, you must come to our office in Abu Dhabi, at your own expense, to claim the car prize retrieval letter which will allow you to collect the car from the designated car dealership in the UAE.

7.7 If you are the winner of gold (for example, a gold bar or coins), you must come to our office in Abu Dhabi, at your own expense, to claim the gold collection voucher which will allow you to collect the gold from the designated jewellers in the UAE.

7.8 Your entitlement to a prize will be lost and you will not be paid a prize if:

you have not claimed your prize within 180 days of the relevant Big Ticket Draw;
your entry into the Big Ticket Draw is the result of any illegal act by you, including, without limitation, any form of money laundering, collusion or other unlawful activity;
your entry fails to pass our validation and security checks, as determined by us in our sole discretion;
we reasonably believe that the entry was bought by or on behalf of a person who is not permitted to register for an online account or purchase a ticket in accordance with section 4.4;
your ticket was purchased using a fraudulent payment method or a card belonging to a third party that has been reported as lost or stolen;
your ticket is defective, mutilated, altered, reconstituted, counterfeit, tampered with in any manner or has not been issued in an authorised manner;
where applicable for our digital Big Ticket Draws, your ticket is not shown on our computer system as a winning entry, as provided for in section 6.4;
your ticket was purchased by another person via your online account (with or without your permission);
you have more than one online account registered with us (including any online account that you have been excluded from and cannot access);
the winning online account is not registered to you, save in the circumstances provided for at section 7.10;
you do not provide your consent or reasonable cooperation in relation to us publicly disclosing and publishing your identity and image to market and advertise our raffle draws pursuant to section 14, except where you object on particular cultural, religious or other reasonable ground for refusal (as determined by us in our sole discretion);
you do not provide us with any documents or information we reasonably request from you; or
you do not otherwise meet the requirements set out in these terms.

7.9 We are not responsible or liable for any disputes about the ownership of a ticket.

7.10 We may, at our sole discretion, pay a prize to your authorized representative if you are unable to claim a prize due to legal, physical, or other disability. In the event of the death of a winner, a person can claim the prize on behalf of such deceased’s estate upon provision of reasonable evidence of the legal right to such prize as part of the deceased player’s estate and, where required, the approval of all competent authorities. Failure to provide such satisfactory evidence and approval will mean the prize is lost as an unclaimed prize.

8. Payment of prizes

8.1 Subject to section 7, prizes shall be claimed and paid in accordance with this section 8.

8.2 All cash prizes will be paid in UAE Dirham (AED).

8.3 Grand cash prize winners can only obtain their prize payment in person at our office in Abu Dhabi (and we will not cover any expenses travelling to our office). Prize payment will be made by cheque and our obligation for payment will be deemed to have been fully discharged once the cheque has been handed to you and you have signed our prize cheque collection form. Exceptions can only be made in extraordinary circumstances and at our sole discretion. Please note that, as a grand cash prize winner, you will also be invited to attend the following month’s Big Ticket live draw, at your own expense, to select the next grand cash prize winner.

8.4 Other cash prizes, excluding grand cash prizes mentioned in section 8.3, will be paid directly to the winner’s bank account in the winner’s country of residence. Exceptions can only be made in extraordinary circumstances and at our sole discretion.

8.5 If you are a Dream Car prize winner, our obligations regarding any car prize are fully discharged once the car prize retrieval letter has been handed to you and you have signed our prize collection form in accordance with sections 7.3 and 7.6. A car may not be collected by any third party on a winner’s behalf, unless we agree otherwise on an exceptional basis at our sole discretion. Please note that it is the winner’s responsibility to: (a) register the car and take out adequate car insurance before driving it on public roads; (b) ensure that they possess the necessary licence(s), qualifications, knowledge and experience to operate the car safely and legally; (c) maintain and service the car; and (d) obtain all necessary approvals and cover all fees and/or duties if the winner wishes to export the car to a country outside of the UAE. We do not export car prizes to foreign countries, and we do not offer any cash alternatives to car prize winners. The car dealership may, however, at its sole discretion, offer a cash alternative. Any such arrangement to accept a cash alternative is solely between the winner and the dealership, and we shall have no involvement, liability or responsibility in such arrangement. Further, we are not responsible for any subsequent transactions, negotiations or dealings any winner may have with the dealership, potential buyers or any other third party regarding the car, nor are we liable for any loss, theft, damage, mechanical defect, or injury resulting from the ownership or use of the car.

8.6 If you are the winner of gold (for example, a gold bar or coins), our obligations regarding any gold prize are fully discharged once the gold collection voucher has been handed to you and you have signed our prize collection form in accordance with sections 7.3 and 7.7. Gold may not be collected by any third party on a winner’s behalf, unless we agree otherwise on an exceptional basis at our sole discretion. Please note that it is the winner’s responsibility to: (a) pay all taxes, customs duties, shipping, storage costs, or other costs or fees incurred in connection with the gold after its receipt. We do not export gold prizes to foreign countries, and we do not offer any cash alternative to gold prize winners. The jeweller may, however, at its sole discretion, offer a cash alternative. Any such arrangement to accept a cash alternative is solely between the winner and the jeweller, and we shall have no involvement, liability or responsibility in such arrangement. Further, we are not responsible for any subsequent transactions, negotiations or dealings any winner may have with the jeweller, potential buyers or any other third party regarding the gold, nor are we liable for any loss, theft, mishandling, damage, or depreciation of the gold.

8.7 We may withhold payment of any prize until we have received such documents and information as set out in section 7 from the winner to our reasonable satisfaction. For the avoidance of doubt, we cannot be held liable if the winner’s country of residence is a jurisdiction which prohibits such a payment or transfer or receipt of such winnings.

8.8 The right to a prize is not transferable, except as otherwise set out in these terms.

8.9 We will not be responsible or liable to any person claiming a prize which has been paid to a person who assumed the identity of the winning ticket holder.

8.10 No interest will be payable on any prize, including, without limitation, whilst any checks or enquiries are carried out in relation to a winning entry, whilst a dispute about the entry or prize claim is being resolved, or for the period a prize remains unclaimed. Prizes to which you are entitled will be held in a dedicated prize money account and on trust for you to claim your prize for a period of 180 days from the date of the relevant Big Ticket Draw.

8.11 You shall be liable for and pay all taxes, duties, levies or similar charges (including value added tax and any goods and services tax) of any nature whatsoever levied, assessed, charged or collected in relation to the award or payment of any prize under these terms.

8.12 If a prize is paid to anyone who does not meet such requirements or is paid to someone erroneously or who is in breach of these terms, that person will be required to repay the prize immediately upon our request.

9. Syndicate play

9.1 Some individuals may choose to participate in our raffle draws as part of a group (herein referred to as a “syndicate”). However, in accordance with section 7 of these terms, only the individual named as the ticket holder will be recognised as the entrant and, in accordance with section 8 of these terms, any prize will be paid in full to the named ticket holder.

9.2 Participation in a syndicate is entirely at your own risk. We have no responsibility or liability whatsoever for: (a) the existence, formation, or operation of any syndicate; (b) the sharing or allocation of any prize among syndicate members; or (c) any disputes, claims, or disagreements arising between syndicate members. It is your sole responsibility to ensure that all syndicate members agree in advance on how any prize will be shared. To avoid misunderstandings, we recommend that syndicate members put in place a clear, written syndicate agreement. For the avoidance of doubt, any dispute relating to a syndicate is strictly a private matter between the individuals concerned and will not be entertained or resolved by us under any circumstances.

10. Using your online account

10.1 By using your online account, you:

consent to us monitoring and recording such use;
represent, warrant and agree that you meet all of the criteria set out in section 4.4; and
confirm that any information you provide to us to open your online account was and remains true and accurate in every respect.

10.2 You are responsible for making sure all of your online account information is accurate and up to date.

10.3 You are responsible for the security of your online account and for keeping your login details secure and secret at all times, and your password unique. You must take steps to prevent your online account and password being used without your permission. If you have forgotten your password or username, you can reset if by following the instructions on the login page on the site.

10.4 You will be required to create a unique password that will be at least 8 to 20 letters, using a combination of upper and lowercase letters, numbers, and at least 1 symbol.

10.5 You must not allow any other person to use your online account, including, without limitation, allowing another person to buy tickets for our Big Ticket Draws using your online account.

10.6 We have the right to close your online account, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms.

10.7 If you know or suspect that anyone other than you is aware of your login details, you must promptly notify us at either help@bigticket.ae or +971 (0)2 201 9244. Similarly, if you suspect that your online account has been compromised, you must notify us promptly at either help@bigticket.ae or +971 (0)2 201 9244.

10.8 You must use your online account only when you are physically located in a jurisdiction where it is lawful to do so.

10.9 You must not use your online account for fraudulent purposes. If we detect, through our monitoring referred to in section 10.1, or have reason to suspect, fraudulent activity occurring, we reserve the right to close your online account in accordance with section 13.3.

11. Player limits and controls

11.1 A maximum monthly spend limit of AED 10,000 (“Maximum Limit”) is automatically set for each customer. If you have created an online account, this Maximum Limit is shared between online purchases and any in-store purchases you make. If you have an online account, you can set your own monthly spend limit, not exceeding the Maximum Limit, through the “My Account” section of your online account.

11.2 You are also able to temporarily exclude yourself from purchasing tickets for any of our Big Ticket Draws (“Self-Exclude”) online for a fixed period of 3 months (“Self-Exclusion Period”). You can do this through the “My Account” section of your online account or by contacting either help@bigticket.ae or +971 (0)2 201 9244. Once you Self-Exclude yourself, you cannot withdraw or amend your decision to Self-Exclude and you will not have access to your online account during the Self-Exclusion Period. If you Self-Exclude, you will also be removed from our marketing and promotional distribution lists for the duration of the Self-Exclusion Period. You may resume purchasing tickets only after the Self-Exclusion Period has expired and by contacting our customer service team.

11.3 You acknowledge and agree that if you choose to Self-Exclude, you will not open or use a new online account during the Self-Exclusion Period, nor will you purchase tickets in store. If you are in breach of the foregoing, we are entitled to close any new online account you register, disqualify any ticket(s) you purchase, and forfeit any prize. We will not be liable to refund you any funds you may have used to purchase the ticket(s) through such new online account or in store.

11.4 By using or visiting our site or registering for an online account on our site or purchasing a ticket for any of our Big Ticket Draws, or, in each case, continuing to do so, you acknowledge that:

you have the physical, mental and financial capacity and sustainability to purchase tickets and enter our draws responsibly; and
you have read and understood all of the information available in the responsible play section of our site.

11.5 If you find yourself spending more money entering our Big Ticket Draws than you can afford, please refer to the responsible play section of our site.

11.6 Nothing in this section 11 shall create a duty of care obligation on us to prevent or mitigate the consequences or aggravation of any self-inflicted harm by you as a result of you buying tickets and entering our Big Ticket Draws. We hereby expressly exclude any such duty of care as well as any responsibility for any adverse effect you may suffer as a result of you buying any tickets and entering our Big Ticket Draws.

12. Promotions

12.1 From time to time we may make promotional offers, such as discounts or additional benefits, for our Big Ticket Draws. Where this is the case, each promotional offer may be subject to additional terms (“Promotional Terms”) where appropriate.

12.2 Where applicable, the Promotional Terms shall be deemed incorporated into these terms, meaning both the Promotional Terms and these terms will apply to you. The Promotional Terms will be made available to you on our site at the time of the relevant promotional offer.

12.3 Promotional offers are not always publicly advertised and are open only to those who meet any eligibility requirements detailed in the Promotional Terms. In any event, you cannot participate if you do not meet the requirements as set out in these terms.

12.4 We may, at our discretion, withdraw any promotional offer or amend any of the Promotional Terms at any time. You will not be entitled to any refunds or replacements as a result of changes to, or the withdrawal of, a promotional offer.

12.5 We may, when reasonably required to do so, replace the stated promotional offer prizes with prizes that we consider to be broadly equivalent in value. We do not offer cash alternatives for non-cash prizes.

12.6 We may, at our discretion, disqualify you from taking part in any promotional offer if we believe you are in breach of either the Promotional Terms or these terms.

12.7 Any entries received after the relevant advertised closing date for a promotional offer will not be accepted.

12.8 To the extent there is any conflict between the Promotional Terms and these terms, these terms shall prevail.

13. Closing your online account or refusing ticket purchases

13.1 You can close your online account at any time by contacting either help@bigticket.ae or +971 (0)2 201 9244.

13.2 Online accounts are limited to one per person. If we discover that you have more than one online account or believe a third party online account is being used by you or on your behalf, we reserve the right to terminate some or all of those online accounts (at our discretion) and take whatever action we reasonably consider appropriate.

13.3 We may terminate access to your online account and/or to our site, or refuse any ticket purchases by you, immediately and without giving you prior notice:

if any information provided by you is provided fraudulently or is inaccurate, out-of-date or incomplete;
we have reasonable grounds to suspect there may be potential financial crime or fraud risks associated with you or your online account;
a court, law enforcement or regulatory authority requests us to stop selling tickets to you or close your online account;
it would breach our legal and/or regulatory obligations to keep your online account open or sell tickets to you;
if we determine that you no longer meet the criteria set out in section 4.4;
on your breach of any one or more of these terms; or
for repair or maintenance work or in order to upgrade or update our site;
if we stop running the Big Ticket Draws, the provision of online accounts, or access to our site or any part of it for any reason; or
for any other reason at our sole discretion.

13.4 Subject to sections 7 and 8, once your online account has been closed (or if you exclude yourself from playing all games in line with section 11.2), any ticket purchased for a particular Big Ticket Draw series prior to online account closure or exclusion is non-refundable and will still enter the draw (except for any tickets purchased in breach of these terms). Prizes due must be claimed in accordance with section 7. However, if we determine (at our sole discretion), following an internal review, that our termination of your online account was appropriately applied at the time in accordance with these terms, you will not be entitled to any prize you win following the closure of your online account, and such funds will be allocated in accordance with applicable regulatory requirements.

14. Use of your information

14.1 By purchasing a ticket and entering one of our Big Ticket Draws, you:

agree that we may disclose and publish your personal information publicly, as we deem appropriate in our sole discretion, including information such as name, nationality, photos, etc;
agree to participate in any reasonable publicity, public relations, marketing or promotional activities at our request; and
hereby grant us a worldwide, irrevocable, perpetual, non-exclusive, sub-licensable and royalty-free licence to use all intellectual property rights in any: (i) information provided by you to us; and (ii) photographs, videos or other media content that features your image and/or likeness, in each case, for our own business purposes, as determined by us, acting reasonably and in good faith, save where you object in writing on particular cultural, religious or other reasonable grounds for refusal (as determined by us in our sole discretion). Such purposes may include, without limitation, marketing and advertising our site or any of our Big Ticket Draws.

14.2 Your refusal to allow us to publish such information and/or take part in such publicity may result in forfeiture of the prize.

14.3 Any intellectual property rights created pursuant to these terms, including as a result of any marketing or advertising activities contemplated by section 14.1, shall automatically vest in us on the date on which they are created. You hereby assign to us all present and future such rights to the extent they vest in you as a matter of law. If requested by us you shall do all things necessary as we may reasonably require to perfect such assignment.

14.4 If you win a prize, you understand and accept that we may, if requested or required by a government agency or body, provide your personal information and the details of any prize claimed by you or paid to you.

15. Changes to these terms

15.1 We may unilaterally revise these terms at any time by amending this page.

15.2 We will notify you of any material changes to these terms from time to time.

15.3 Please check this page from time to time to take notice of any changes we make, as they are binding on you.

16. Changes to our site

We may update our site from time to time and may change the content at any time. Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up-to-date.

17.1 Our site is made available free of charge.

17.2 We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. If you choose to access our site from outside the UAE, you do so at your own risk.

18. Your use of our site

18.1 In using our site you agree that you shall not:

do anything to encourage, procure or carry out any criminal activity;
use our site for any purpose other than your personal use;
use our site for any purpose that is against any law, including, without limitation, any form of money laundering, collusion or cheating;
email, transmit or otherwise disseminate any content which is in our sole opinion defamatory, obscene, in breach of copyright or any other third party rights, vulgar or indecent or may have the effect of being harassing, threatening, abusive or hateful or that otherwise degrades or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability or is otherwise unlawful;
advertise or promote third party or your own products or services including by way of the distribution of 'spam' email;
transfer files that contain viruses, trojans or other harmful programs; and/or
access or attempt to access the online accounts of other users or penetrate or attempt to penetrate our site's security measures.

18.2 We reserve the right to restrict or terminate your access to our site at any time without notice at our discretion if we have reasonable grounds to believe you have breached any of the restrictions above.

19. Our discretion is final and binding

The reasonable exercise by us of any discretion provided for by these terms (including, without limitation, where this results in a prize not being paid) will be final and binding.

20. Intellectual property rights

20.1 We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

20.2 You may print off one copy, and may download extracts, of any page(s) from our site for your personal use.

20.3 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

20.4 Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

22. Limitation of our liability

22.1 Nothing in these terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

22.2 To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

22.3 You agree to indemnify, defend, and hold us harmless against any and all costs, losses, damages, liabilities, and expenses (including reasonable legal fees) that we may incur as a result of any claim, action, or demand made by a third party arising from your negligent or improper use of your online account, your participation in our Big Ticket Draws, your access to our site, or your breach of these terms.

22.4 We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

use of, or inability to use, our site;
use of, or reliance on, any content displayed on our site;
delay, postponement or cancellation of any Big Ticket Draw;
our compliance with any applicable laws (including if we determine we are prohibited by any applicable law from providing you with a prize (including, without limitation, due to a sanctions designation));
our refusal to sell a ticket to you or to allow you to enter a Big Ticket Draw;
events beyond our reasonable control (including, without limitation, epidemic or pandemic, war, strike, fire, flood, drought, power cut and/ or failure or obstruction of any network, broadcasting or telecommunications service); or
your breach or non-compliance with these terms and/or applicable laws.

22.5 If there is an error, defect, misconfiguration, malfunction, or failure, whether visual, technical, system-related, or human in nature with respect to our site (including an error, defect, misconfiguration, malfunction, or failure in a the operation of a Big Ticket Draw), which results in you incorrectly being awarded a prize, we may, at our reasonable discretion:

restrict or terminate your access to our site at any time without notice, whereupon you will not be entitled to receive such prize;
void a ticket or the outcome of a draw as set out in section 6.9; and/or
request that you repay such prize to us, which you shall do immediately on receipt of such a request.

22.6 Please note that we only provide our site for non-commercial use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

22.7 We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.

22.8 We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

22.9 Subject to section 22.1, our aggregate liability in contract, tort (including negligence or breach of statutory duty) misrepresentation or otherwise in connection with these terms shall not exceed AED 500.

23. Viruses

23.1 We do not guarantee that our site will be secure or free from bugs or viruses.

23.2 You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software.

23.3 You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

24.1 You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

26. Phishing and scammers

26.1 Scammers use email or text messages to try to steal your passwords, account numbers or Emirates ID numbers. If they get that information, they could get access to your email, bank, or other accounts, including your Big Ticket online account. Or they could sell your information to other scammers.

26.2 Scammers often update their tactics to keep up with the latest news or trends. For example, you may receive a communication using our logos or even email domain name saying you have won a large prize and to claim that prize you must provide your bank account details over email, by text message or over the telephone. Please note that we will never ask for this information unless it is in person or over a secure online and automated portal.

26.3 If you believe, or should have reasonably believed, you have been the victim of fraud, a scam, your online account has been subject to a breach or unauthorised access, please contact us as soon as reasonably practicable at either help@bigticket.ae or +971 (0)2 201 9244 to verify it.

26.4 We are not liable for any losses you suffer as a result of you falling victim to fraud, a scam, your online account being subject to a breach or unauthorised access or your payment card being lost, stolen or otherwise compromised.

27. Third party links and resources in our site

27.1 Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only.

27.2 We have no control over the contents of those sites or resources.

28. Other provisions

If there is any inconsistency between these terms, our specific Big Ticket Draw rules and draw procedures, our key terms, our privacy policy, any Promotional Terms or any information in our marketing materials or provided to you by our customer service team, the following order of precedence shall apply:

firstly, these terms of use;
secondly, our specific Big Ticket Draw rules and draw procedures;
thirdly any Promotional Terms;
fourthly our key terms set out in section 2; and
lastly our privacy policy.

29. Assignment and sub-contracting

29.1 You shall not assign, sub-contract, transfer, charge or otherwise dispose of all or any of your rights and responsibilities under these terms.

29.2 We may assign, sub-contract, transfer, charge or otherwise dispose of all or any of our rights and responsibilities under these terms to any person without your prior consent.

30. Entire agreement

These terms, and any Promotional Terms if applicable, contain the entire agreement between you and us relating to such subject matter. Except as required by law, no terms shall be implied (whether by custom, usage or otherwise) into these terms or, if applicable, any Promotional Terms.

31. Applicable law

Please note that these terms, their subject matter and their formation, are governed by the laws of the Abu Dhabi Global Market. We both agree to the exclusive jurisdiction of the courts of Abu Dhabi Global Market.

32. Language

The language of these terms is English and all notices and communications to be given in connection with these terms shall be in English. All demands, requests, statements, certificates or other documents or communications to be provided in connection with these terms shall be in English. If these terms are provided in another language, the English version shall prevail.
